Carolina Arbors by Del Web

arolina Arbors by Del Web?  What is that I asked the wife.  I thought it was another line of furniture she was interested in.  We have lived in Durham, NC for over a year and I have never heard of Carolina Arbors by Del Web even though I sell residential real estate.

It turns out Carolina Arbors by Del Web is only about 15 minutes from my house.  How about going and taking a look around.  It was quite an interesting place and was not quite like any other new construction site I had been too.  
The site office at Carolina Arbors by Del Web was huge and two ladies wanted to know if I wanted water or some coffee.  Very laid back.  I guess they figured if I was there it was to look at homes.  They gave me some information and showed me the way to the model homes.  They offered me a pass so I could go to the club house and take a look around.  After spending over two hours looking at models homes that start at $309,000 I thought I would save that for another day.  
Carolina Arbors by Del Webb features a 34,000 sq. ft. amenity center that includes an indoor pool, billards, varsity rooms, fitness pickelball, tennis, Bocce Courts and an outdoor Saline Pool.  There is also a dog park and pocket parks around the commumity.
The Brier Creek Shopping Center is only a mile away with all of the big time stores right there as well as my favorite, Earth Fair.  Umstead State Park is close as well as the RDU International Airport.  Not sure how I missed this 460 acre new home site, Carolina Arbors by Del Web, but I will be going back to check it out for my over 55 customers.
Did I mention that Carolina Arbors by Del Web is only for us folks 55 and older?  It surely is and all of the homes have first floor bedrooms.  They are all very open floor plans with lots of light as well as amenities.  If you would like a tour please contact me so I can arrange one for you.  This is the place to be.

New Way To Visit Downtown Raleigh

Do you travel through downtown Raleigh and wish there was a way to know about parking, street closures, fun things to do? Are planning a trip?  If so there is an app for that called the Downtown Raleigh  app from the Downtown Raleigh Alliance.

The Downtown Raleigh app is meant to help guide visitors around downtown Raleigh.  Pepsi, ABC 11 as well as the city all sponsored the project.  The city in 2014 kicked in $5,000 to get the party started.  
The Downtown Raleigh app is constantly updated, a source for all things Downtown Raleigh in which you can view business listings.  But not just any business listings.  The app concentrates on shopping, nightlife, dining and other attractions.  You can get directions from you current location by walking, driving or even the R-LINE (transit). If you are like me you need help finding parking and this app delivers that.  Want to know what specials your favorite restuarant has going on?  Check out the app.  You can even check Instagram for many places to get up to the minute on happenings.  
Oak City Apps developed the app and wanted to make sure the app is usable. The home screen features portals to lists of places to dine, have fun or maybe a drink or two.  To download the Downtown Raleigh app visit your favorite market store.

Due Diligence in Durham, NC

The Due Diligence Fee in Durham, NC is new to me.  I come from Virginia Beach and we don't have that type of fee there.  This is an article from the North Carolina Association of Realtors  that explains what happens if the buyer and seller agree to a ZERO amount for the fee.

QUESTION: I represent a seller. I just received an Offer to Purchase and Contract on Standard Form 2-T. In paragraph 1(d), on the line designating the Due Diligence Fee, the buyer inserted a zero. In paragraph 1(j), where the Due Diligence Period is defined, the buyer inserted a date that would equate to a roughly a three week due diligence period. If my client signs the offer, will the buyer have waived any right to terminate the contract prior to the end of the due diligence period by failing to offer or pay a due diligence fee? 
ANSWER: We answered this question once before, shortly after the introduction of the "due diligence contract" in 2011. However, we continue to hear the question fairly frequently. Therefore, our answer bears repeating.
The answer is that a buyer does not waive any due diligence rights by failing to offer or pay a Due Diligence Fee. The Contract and the very way it is organized anticipates that a buyer will have the right to conduct due diligence, and to terminate the contact prior to the end of the due diligence period, whether or not a due diligence fee is paid.
Paragraph 1(i) of the Contract defines "Due Diligence Fee” as "[a] negotiated amount, if any, paid by Buyer to Seller with this Contract for Buyer's right to conduct Due Diligence during the Due Diligence Period." The last sentence of the definition reads: "Buyer and Seller each expressly waive any right that they may have to deny the right to conduct Due Diligence... based on the absence or alleged insufficiency of any Due Diligence Fee, it being the intent of the parties to create a legally binding contract for the purchase and sale of the Property without regard to the existence or amount of any Due Diligence Fee.”
If the parties to a Contract desire to limit or eliminate the buyer’s right to do due diligence and/or terminate the contract for any reason or no reason during the due diligence period, it would require either the use of a different form, or significant modifications to the Contract that should be handled by a North Carolina real property attorney.

Fund For North Carolina Underground Storage Tank For Residential Properties Gets Tanked

The state of North Carolina in its infinite wisdom has done away with a fund that helped to mitigate damage from abandoned underground storage tanks for residences. If you are buying or listing a property with an abandoned underground read this blog from the North Carolina Association of Realtors. This page provides information and resources about how changes to the underground storage tank fund impacts your clients and your business. Information will be updated as it becomes available. Overview One provision in this year’s state budget (H97) was the elimination of the noncommercial underground storage tank fund. Here are the details of the provision: Appropriates a nonrecurring sum to the Noncommercial Fund; Uses the remaining balance of the Noncommercial Fund to pay the cleanup costs of releases reported to the Department of Environmental Quality (formerly the Department of Environment and Natural Resources) prior to October 1, 2015 and determined to pose unacceptable risk (the $2,000 deductible applies); Eliminates the Noncommercial Fund moving forward; and Provides temporary rules that alter the requirements for remediation when a leak from a noncommercial tank is discovered. NCAR believes this fund was vital to the protection of North Carolina’s environment and its property owners. The fund was established to reimburse property owners for costs incurred during the cleanup of soil and groundwater contamination resulting from the release of petroleum from an underground storage tank. While no hard data exists on the precise number of noncommercial underground storage tanks in North Carolina, a reasonable estimate is approximately 200,000. NCAR is concerned that the elimination of this fund could have a negative impact on the real estate market. The Government Affairs staff continues to work with members of the NCGA and Department of Environmental Quality staff to find ways to lessen any negative impacts this change will have on the market.
